The decree, which imposes conditions on the merger under the 'Golden Power' rule, has raised concerns about compliance with Article 21 of the EU Merger Regulation. The Commission found the justification for these conditions lacking and noted potential breaches of other EU laws. An Italian court has partially annulled the decree, and the Commission is awaiting further information from Italy before proceeding.
